SENYUM REJEKI TERMS AND CONDITIONS
Effective as of 1 June 2024
This terms and conditions (“Terms and Conditions”) is an agreement that governs the relationship between the User (“You”, “Yours”, “Yourself”, or “Users”) and PT Senyum Rejeki Digital (“We”, “Us”, “Our” or “Senyum Rejeki”), a limited liability company duly established and legally operating under the laws of the Republic of Indonesia. This Terms and Conditions governs Your use of Our application and website https:/senyumrejeki.com, and its contents provided by Us (hereinafter, collectively referred as “Platform”), as well as use of Our services available on Our Platform (“Service” or “Services”).
We may update the Terms and Conditions from time to time for legal reasons, regulatory reasons or should We see that such Terms and Conditions needs to be updated. In such case, We will reasonably inform You of such changes, including through the use of notifications in the Platform or through Your e-mail address prior to the changes becoming effective. If You continue to use such Services after the date of which the changes come into effect, You hereby agree to be bound with the new Terms and Conditions.
Applicable Laws refers to applicable laws, by-laws, enactments, regulations, regulatory policies, ordinances, protocols, industry codes, regulatory permits, regulatory licenses or requirements of any court, tribunal or governmental, statutory, regulatory, judicial, administrative or supervisory authority or body, under the Republic of Indonesia;
Force Majeure refers to event that occurs beyond Our authority or control, including but not limited to electricity disruptions, telecommunication disruptions or failures, natural disasters, government policies, riots and civil unrest, war, and other events;
Giveaway Contest refers to the giveaway contest organized by Us, a Service available on the Platform;
Member or Members is the status of an individual being a member after purchasing or subscribing to Our Services, where they can utilise the exclusive discounts on offer and manage all their payments and update details as needed. In this case, members are automatically entered in the Giveaway Contest as provided in Our Platform;
Membership means a prove of on-going subscription as a Member, which is paid through monthly direct debit, or through an upfront billing period of 1 (one), 3 (three) or 12 (twelve) months;
Participant means any Member who takes part in Our Giveaway Contest;
Privacy Notice means the Senyum Rejeki’s Privacy Notice, which is an integral part of this Terms and Conditions;
Services or Service means any features and/or products that are available in Our Platform, including but not limited to, the exclusive discounts, and Giveaway Contest;
Terms and Conditions means this Senyum Rejeki’s Terms and Conditions;
Third Party Contents are contents related to Our Services that was created or developed by a third party, such as the contents, information, services, products, and/or exclusive discounts provided on Our Platform and/or Our Services;
Third Party Provider is any unaffiliated person, company, or entity that performs services for Us, including retailers cooperating with Us, and electronic payment method providers for Our Services;
Users are individuals who uses Our Platform;
Verification Mail are message that will be sent to Your e-mail to verify Your account registration;
Platform refers to Our website www.senyumrejeki.com and our application organized by Us to deliver Our Services for Users and/or Members;
We, Us, Our, or Senyum Rejeki means Us, PT Senyum Rejeki Digital who organized and operates the Platform and/or Services;
You, Yours, Yourself, or Users means you, an individual using Our Platform, and/or Member, and/or Participant.
The Senyum Rejeki is a membership rewards platform that offers its members discounts at retailers across Indonesia. Members, after subscribing to the regular membership get access to a member’s dashboard where they can utilise the exclusive discounts on offer and manage all their payments and update details as needed. Members are automatically entered in a Giveaway Contest organized by Senyum Rejeki which also features in the Platform.
Access and usage of the Platform are subject to the provisions stipulated under this Terms and Conditions. Senyum Rejeki reserves the right to add, change, modify, suspend or discontinue any portion of the Service, in its sole discretion, at any time. In addition, Senyum Rejeki may impose limits on any portion of the Service or restrict Your access to portions of or the entire Site in its sole discretion without notice or liability.
Prior to accessing some parts of the Platform and/or using our Services, You will need to register Yourself with Us to create an account by providing the information that We need, such as Your full name, Your e-mail address, and Your mobile phone number. In addition to information related to You, You will also be required to input Your password which will be used whenever You log into Your account on Our Platform.
You agree that all information You provide to Senyum Rejeki for purposes of creating an account will be true, accurate, current, and complete and Your failure to provide such information shall constitute a breach of these Terms and Conditions and may result in the immediate termination of Your account. You may add or change Your information on the settings of the Platform. You shall (i) promptly update Your registration information to keep it true, accurate, current, and complete; and (ii) maintain the confidentiality of Your password.
Once You have successfully registered, Our system will send You a verification e-mail (“Verification Mail”) to the registered e-mail You have provided. You have to verify Yourself by following the verification steps mentioned in the e-mail, once you’re done, You will be redirected to Our Platform.
THE VERIFICATION MAIL IS GENERATED AUTOMATICALLY BY OUR SYSTEM. DO NOT CONTINUE THE VERIFICATION STEPS IF YOU RECEIVED THE E-MAIL BY MISTAKE OR DID NOT AUTHORIZE THE REQUEST FOR VERIFICATION.
After the verification is complete, Our system will create a personalized account for You to use the Platform and the Services.
The account will be linked to Your e-mail address, which means that You cannot create another new account with a registered e-mail address. This applies as well if You later change Your e-mail address of Your account.
Your account is exclusively available to You only. Your account functions as a profile under Our Platform, which may provide You access to enjoy the Services (after subscribing to Our Membership) We provided under Our Platform.
Your account cannot be used or transferred to any other party for any reason. Senyum Rejeki reserves the right to terminate and discontinue the Service which We provide to You if We know, reasonably know or have sufficient grounds to believe that Your account has been used or transferred to someone else.
You are responsible for the security, confidentiality and safekeeping of Your account. We always maintain Our capacity and capability to deter and prevent any form of intrusions, misuse, mishandle or any other unlawful acts directed towards Your information. Any form of losses, damages and risks arising in part or wholly to Your negligence to maintain sufficiently the security of Your account, shall be borne by You. We assume that any order or functions created by Your account under Our Platform are Your legitimate request.
Should You suspect that Your account has been unlawfully and used without Your consent and knowledge by someone, please notify Us as soon as possible. We will take reasonable action to secure Your account.
Once signed up and subscribed, You will become a Member, which is a regular membership with the choice of a monthly through direct debit, or through an upfront billing period of 1 (one), 3 (three), or 12 (twelve) months (yearly) membership fee (“Membership”). There are no automated debit for upfront billing method Membership.
This Membership of Senyum Rejeki is subject to these Terms and Conditions. This Membership is an on-going subscription until cancelled by You or terminated by us in accordance with this Terms and Conditions.
Each Membership receive 1 (one) entry into every Giveaway Contest organized by Us. Additionally, You may also subscribe to other types of Membership in our Platform which subsequently will provide you with longer period to access the benefit as a member, in accordance with the type of Membership that you subscribe.
You may cancel Your Membership at any time by emailing Us. We will then provide You with a link where You will prompted with steps to cancel Your Membership.
Once the cancellation process is complete, Your Membership will be cancelled instantly and You will be sent a confirmation e-mail. No refund will be offered if You cancel Your Membership mid-billing cycle for any reason or if You do not complete the cancellation process before the payment comes out. This applies to all billing choices (monthly or upfront billing of 1 (one), 3 (three), or 12 (twelve) months) Memberships.
Cancellation of Your Membership will not remove You from Our marketing database. To remove Yourself from Our marketing database, You must click the unsubscribe link in the promotional e-mail or message (as relevant) and follow the prompts.
If, for any reason, a direct debit for payment of Your Membership fails, we will attempt to debit Your payment on further occasions after the initial payment failure. Further provisions will be subject to the policies and procedures of Our Third Party Provider, the payment gateway processing the transactions payment.
Upon the termination or cancellation of Your Membership, You may re-subscribe to the Membership at any time.
By becoming a Member of Senyum Rejeki the Member agrees to enter the Giveaway Contest as a Giveaway Contest participant (“Participant”) and agrees that:
In order for Us to provide You with Our Services under the Platform, We may collect, store, process and share Your personal data which You have provided when signing up Your account, purchasing a Membership, or when You use Our Platform and/or Services. By signing up Your account, purchasing a Membership, use Our Platform and/or Services, You represent that You have read and consent to Our Privacy Notice, which is an integral part of this Terms and Conditions.
In relation to Our Platform and/or Services, the contents, information, services, products, and/or exclusive discounts (“Third Party Contents”) under Our Platform may be provided by a third-party cooperating with Us, including any electronic payment method providers (“Third Party Provider”). Third Party Contents are subject to the applicable terms and policies of the third parties that offer them.
We are not liable for any part of the Third Party Contents. We may, but not obliged to, verify that Third Party Contents shall be in conformity with this Terms and Conditions and the Applicable Laws. In the event that such Third Party Contents is inaccurate and We are informed of such inaccuracy, We will attempt to correct the inaccuracies as soon as We reasonably can.
We reserve the right to suspend Your account, on a temporary or permanent basis because of, including but not limited to, the following:
If We know or have sufficient reasons to suspect that You have committed immoral acts, violations, frauds, crimes and/or other actions that is in contrary with this Terms and Conditions and/or Applicable Laws, whether or not referred to in this Terms and Conditions, then We have the right to and may suspend Your account, either temporarily or permanently, or stop Your access to Our Platform, including Services, Third Party Contents, offers and/or payment method contained therein, investigate, claim compensation, report to authorized parties and/or conduct other actions that We consider necessary, including criminal and civil law proceedings.
You represent and warrant that You are at least 18 (eighteen) years old or are married and are not under guardianship or custody and that You are legally capable and have the right to bind Yourself into this Terms and Conditions according to the Applicable Laws. Should You not meet such criterions and You still access or use our Platform, Services, and Third Party Contents, You warrants that such actions, including Your action of signing up into Our Platform, accessing or conducting activities within Our Platform are based on the consent of Your parents, guardians or custodians.
You agree to access or use of Platform, Services and Third Party Contents solely for the purpose specified under this Terms and Conditions and that You warrant not to misuse the Platform, Services, and Third Party Contents provided to You.
You understand and agree that all risks arising from the use of the Platform, Services and Third Party Contents are entirely Your responsibility, and You hereby release us from any claims regarding damages, losses, potential losses or other forms that is caused or is a system disruption(s) as it may be made by unauthorized parties.
You expressively release Us, including but not limited to Our officials, Our employees, directors, commissioners and agents from all obligations, consequences, material or immaterial losses, claims, fees (including advocate and or legal fees that might arise) or legal responsibilities that arise or may arise because of Your violation of this Terms and Conditions, or in connection with Users, or Third Party Provider.
For a Giveaway Contest, the Participant represents and warrants that it shall not contact the any affiliate, employee, sponsor or partner of Senyum Rejeki in order to manipulate the Giveaway Contest results.
Excluded from the foregoing, if there is a direct loss due to Our violation of this Terms and Conditions, then You agree and expressly limit the amount of Your claim as to the total amount actually incurred or paid in connection to the event.
YOUR USE OF THE PLATFORM AND/OR THE SERVICES, OR THE PURCHASE OF OUR MEMBERSHIPS, SIGNIFIES YOUR AGREEMENT TO THESE TERMS AND CONDITIONS AND CONSTITUTES YOUR BINDING ACCEPTANCE OF THIS, INCLUDING ANY MODIFICATIONS THAT SENYUM REJEKI MAKES FROM TIME TO TIME.
BY CONTINUING ACCESS OR USE TO THE PLATFORM AND/OR SERVICES, YOU HEREBY AGREE TO SUBJECT TO AND COMPLY WITH ALL OF APPLICABLE LAWS AND THIS TERMS AND CONDITIONS INCLUDING ALL OF ITS AMENDMENTS. IMMEDIATELY STOP TO ACCESS OR USE THE PLATFORM AND/OR SERVICES IF YOU DO NOT AGREE TO ANY PART OF THIS TERMS AND CONDITIONS.
Our Platform and Services are protected by intellectual property rights as available under the laws of the Republic of Indonesia, which are registered on behalf of Us or Our affiliates. The following items, such as but not limited to, names, logos, program codes, designs, trademarks, technologies, database, business process, and models are also protected by intellectual property rights as made available under the laws of the Republic of Indonesia. We have all the rights and interests of the Platform and Services, including all intellectual property rights of the features contained within the Platform.
Any duplication, distribution, creation of derivative works, sale or offer to sell, display in whole or in part, and use of Platform and/or Our Services from unauthorized accesses, such as but not limited to the use of additional Platform, Platform which is published from unofficial digital markets, emulators, mirrors, and other means of unofficial publication, which diverges from this Terms and Conditions as well as the intended purposes determined by Us, is a violation of Our intellectual property rights.
You may not:
The Platform that We provide is “as-is” and We do not represent, warrant, nor be liable of that the reliability, timeliness, quality, stability, availability, accuracy, completeness and or security of the Platform will fulfil Your needs and Your expectations, including the Services and Third Party Contents, that may be available under Our Platform. We shall not be responsible for any loss or damage caused by any Third Party Contents that are available or Your failure or mistake in complying to Our Terms and Conditions.
Our Platform may experience several limitations, including delays and other issues that are related to the use of internet and electronic communication, including Your device should it be broken, not connected to the internet, out of range, turned off or not functioning. We are not responsible for such delay, failure of delivery, damages or loss that arises from such problems.
We do not have the responsibility to oversee Your access or use of the Platform. However, for a positive experience for all of Our Users under Our Platform, We may supervise the usage of the Platform and to ascertain compliances with this Terms and Conditions, Applicable Laws, court orders, and or administrative institutions or other competent government bodies requirements.
We do not have any responsibility, including to take further actions or legal actions deemed necessary by Users, for any problem or dispute arises between Users. When We facilitate a resolution of problems or disputes between Users, We do not act as a mediator and such an action does not cause any further responsibility to Us.
We do not have any responsibility towards any and/or all of the part of Third Party Contents as previously explained, including pictures, information, data, any form of trademark, any other form of information as may be contained under the Third Party Contents, including any form of information related to information that We crawled through the world wide web or any information that is procured from the links to other websites or material which are beyond Our control. We will provide reasonable measure to ensure that such Third Party Contents will not contradict to the Applicable Laws and our Terms and Conditions and We reserve the right, but not the obligation, to erase such Third Party Content from our Platform, should We understood that such Third Party Contents contradicts to the Applicable Laws and/or Our Terms and Conditions, including should it be misleading, inaccurate, or infringes intellectual property of Us or other parties.
The Services are controlled and operated by Us from the Republic of Indonesia. We do not represent or warrant that the Services, or any part thereof, are appropriate or available for use in any particular jurisdiction. Those who choose to access the Services, do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. We may limit the availability of the Services, in whole or in part, to any person, geographic area or jurisdiction that We choose, at any time and in Our sole discretion.
In the event of Force Majeure, including but not limited to electricity disruptions, telecommunication disruptions or failures, natural disasters, government policies, riots and civil unrest, war, and other events, You hereby agree to release Us from any demands and responsibilities, if We are not able to facilitate such Service, including the fulfilment of Your request made through the Platform, either in part or whole, due to a Force Majeure.
The Terms and Conditions shall be governed according to the laws of the Republic of Indonesia.
Any and all disputes arising from the use of the Platform, Services and/or the implementation of this Terms & Conditions, You acknowledge and agree that You will, as an initial matter, e-mail Us to describe to Us the nature of Your complaint or dissatisfaction, which We may try to resolve amicably. However, if for some reason Your problem or dispute is not resolved satisfactorily within 30 (thirty) days after Our receipt of Your written description of it, You agree to the further dispute resolution, which is are subject to the exclusive jurisdiction of the South Jakarta District Court. To the extent permitted by Applicable Laws, any dispute resolution should begin with reporting the issue via e-mail to Us as an initial resolution, as previously explained, prior to the exclusive jurisdiction of the South Jakarta District Court.
